Gegenstand der Gerechtigkeitstheorie nach Rawls, ist die moralische Bewertung von gesellschaftlichen Strukturen und Institutionen, nicht einzelner Handlungen von Individuen. Dabei ist Gerechtigkeit die erste Tugend sozialer Institutionen. Die Idee einer wohlgeordneten Gesellschaft, in der notwendige Gerechtigkeitsgrundsätze allgemein akzeptiert sind, schafft eine faire Ausgangsposition. Die hypothetische Vertragssituation ist eine Operationalisierung der Idee der Unparteilichkeit in Gestalt eines Urzustandes, in dem die Teilnehmer sich hinter einem Schleier des Nichtwissens befinden, welcher die moralisch willkürliche Verteilung von natürlichen Gütern wie Intelligenz, Lebenskraft, Phantasie oder Gesundheit durch die Lotterie der Natur neutralisiert (vgl. Thielmann). Die Verteilung der natürlichen Güter ist weder gerecht noch ungerecht. Als gerecht oder ungerecht kann allein bezeichnet werden, wie Institutionen mit dieser natürlichen Verteilung umgehen. Den Begriff der Gesundheit versteht Rawls als ein öffentliches Gut im ökonomischen Sinn (z.B. Impfprogramme oder andere Gesundheitsdienste). Er stellt die Idee einer besonderen Zahlung im Krankheitsfall im Rahmen einer negativen Einkommenssteuer auf. Doch die Anwendungsmöglichkeiten der Theorie sind begrenzt, denn was ist mit denen, die nicht um diese Dinge, die auf Jobs, Ämter und Karrieren fokussiert sind, konkurrieren Eine Möglichkeit besteht darin, zu den Grundgütern die Gesundheitsversorgung hinzuzufügen, bzw. die Liste der Grundgüter und der Gerechtigkeitsgrundsätze zu erweitern. Ronald Green, zum Beispiel, sieht Gesundheitsversorgung als ein soziales Grundgut, denn sie scheint im Urzustand wichtiger als das Einkommen zu sein. Die weitere Möglichkeit besteht in einer Erweiterung der Gerechtigkeitsprinzipien um ein drittes Prinzip, das allen unabhängig von ihrer gesellschaftlichen Stellung gleichermaßen Zugang zu einer Gesundheitsversorgung garantiert, die so umfangreich sein soll, wie die Gesellschaft es zulässt (vgl.
