In an episode of the well known British BBC television series of Yes Prime Minister entitled 'A Victory for Democracy' the Prime Minister, the Right Honourable James Hacker, is recorded in his diaries to have challenged the redoubtable civil servant, Sir Humphrey Appleby, by asking, 'Humphrey are you saying Britain should not be on the side of law and justice?'No, no of course, we should', Sir Humphrey answered emphatically. 'We just shouldn't allow it to affect our foreign policy, that's all'.In this paper, Lindell explores the role of judicial review in the conduct of foreign affairs as illustrated by cases in the United Kingdom, Ireland and the United States. The cases concerned are two military actions conducted against Iraq in 1990-1991 and 2003, respectively, and also an English case arising out of the military action in Afghanistan in the so-called 'War on Terrorism' which followed the destruction of the New York Twin Towers buildings on 11 September 2001. The cases discussed deal with justiciability, the relationship between domestic and international law (including the relationship between public and private international law) and the scope of prerogative powers over defence and foreign affairs.
