    Eligibility

  5. To be eligible, you must be a verifiable legal resident of Canada, excluding Quebec, who has reached the age of majority in your province or territory of residence at the start of each applicable Contest Period (“Entrant”).
  6. You are not eligible if you are an employee of Indigo or its respective parents, subsidiaries, affiliates, advertising, promotional and public relations agencies, or a member of the immediate family or household of such employees. For the purposes of these Rules, “member of the immediate family” means spouse, including common law spouse, father, mother, son, daughter, brother and sister of the entrant, regardless of where they reside.
  7. Entrants must be natural persons. Groups, clubs, organizations, businesses and commercial and non-commercial entities cannot participate.
  8. How to Participate

  9. No purchase necessary. There are 4 ways to enter the “Kobo Glo HD Giveaway” Contest (“Contest”) – maximum one (1) entry across all eligible social channels and one (1) winner per eligible social channel. See chart in Paragraph 2 above for the Entry Method for each Contest Period.
  10. For any Contest Period with a Facebook Entry Method: To enter, you must have a Facebook account and between 5 PM EDT and 11 PM EDT on the applicable Contest Period (i.e. April 26th, 2016), go to the Indigo or Indigo Kids’ Facebook page at www.facebook.com/ChaptersIndigo or www.facebook.com/IndigoKids respectively, “like” the Contest post and leave a comment with an answer to a question that will be posted by Indigo (e.g., How would a Kobo Glo HD change how you read?).
  11. For any Contest Period with a Twitter Entry Method: To enter, you must have a Twitter.com account and follow @chaptersindigo on Twitter. Between 5 PM EDT and 11 PM EDT on the applicable Contest Period (i.e. April 26th, 2016), you must follow the action instructions in the Contest tweet, which will be to:
    a. retweet the Contest tweet posted by the @chaptersindigo profile feed at www.twitter.com/chaptersindigo
  12. For any Contest Period with an Instagram Entry Method: To enter, you must have an Instagram account and follow @chaptersindigo on Instagram. Between 5 PM EDT and 11 PM EDT on the applicable Contest Period (i.e. April 26, 2016), you must “like” the Contest image post on the @chaptersindigo Instagram profile and tag a friend in the comment section of the post.
  13. Don’t have an account?
    For Facebook, visit www.facebook.com; for Twitter, visit www.twitter.com; and for Instagram, download Instagram for iPhone or iPad from the App store or for Android from Google Play. For each, follow the instructions on how to create your account. There are no fees associated with the creation of an account. By creating an account, each Entrant agrees to comply with the Terms of Service of the applicable platform.
  14. One account per person per social media platform. One entry per person per Contest Period.
  15. Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple Facebook, Twitter, or Instagram accounts, shall be deemed as tampering and may disqualify you from entering, participating, winning prizes, and preclude you from participating in future contests and promotions, at the sole discretion of Indigo. Registration Forms that contain false or incomplete information may be void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions these rules will be judged void. All entries become the property of Indigo upon receipt and none will be returned. Proof of transmission (screenshots or captures, etc.) does not constitute proof of receipt. The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).
  16. Prize Descriptions and Conditions

  17. There are a total of four (4) prizes available to be won during the Contest Period. Prize descriptions will be announced by Indigo on the applicable social media platform for the Contest Period, as indicated in the chart in Point 2 above.
  18. LIMIT: One prize per person during the entire Contest Period.
  19. The prizes may not be exchanged and must be accepted as awarded, without substitutions, are non-refundable, non-transferable, may not be sold, and cannot be replaced if lost or stolen. Indigo reserves the right to substitute a prize for one of equal or greater value (based on the approximate retail value of the prize as stated in these Contest Rules), if the prize cannot be awarded as described for any reason.
  20. Random Draw

  21. For each Contest Period, a random draw will be held at Indigo’s Head Office in Toronto, Ontario on April 27, 2016 at 12 PM EDT from all eligible entries received for that Contest Period.
  22. Odds of winning will depend on the total number of eligible entries received during each Contest Period.
  23. Selected winner(s) for the prize(s) will be notified by direct message on Instagram, reply to comment on Facebook, and tweet on Twitter on April 27, 2016.
  24. Winner Confirmation

  25. To be confirmed a winner, each selected entrant must: (i) be in full compliance with these Official Contest Rules; (ii) by 11:59 PM EST of April 27, 2016 , send an email to the email address provided to the potential winner in a post by Indigo on the applicable social media platform; and (iii) respond, within 24 hours of the email sent from Indigo, with the correct answer (without assistance of any kind, whether mechanical or otherwise) to the mathematical skill-testing question and agree to the release of liability and publicity.
  26. In the event that a selected entrant cannot be contacted and confirmed the winner as above or in accordance with these Official Contest Rules, he/she will be disqualified at the sole discretion of Indigo, his/her entitlement to receive a prize will be forfeited, and a new selected entrant will be randomly selected from the Entrants for that Contest Period. No correspondence will be entered into except with selected entrants.
  27. Within thirty days of Indigo receiving a signed Declaration and Release Form each prize winner will be sent his/her prize by mail or courier or a mutually agreed to form of delivery.
  28. Conduct

  29. By participating in the Contest, entrants acknowledge that they have read and understood these Contest Rules and agree to abide and be bound by them. Entrants further agree to abide and be bound by all decisions of Indigo, which shall be final and binding, without right of appeal, in all matters relating to this Contest and the awarding of the prizes. Entrants who have not complied with these Contest Rules are subject to disqualification at Indigo’s sole and absolute discretion.
  30. Indigo also reserves the right, in its sole and absolute discretion, to disqualify any entrant that it finds to be: (a) violating the Contest Rules; (b) tampering or attempting to tamper with the entry process or the operation of the Contest, Contest pages, or any website associated with this Contest; (c) acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person or (d) attempting to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other unfair playing practices or intending to annoy, abuse, threaten or harass any other entrants or Indigo representatives. If Indigo suspects that an entrant has engaged in an unsportsmanlike or disruptive manner, the entrant will be contacted as soon as practicable. CAUTION: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE CONTEST PAGES, OR ANY WEBSITE ASSOCIATED WITH THIS CONTEST OR TO UNDERMINE THE LEGITIMATE OPERATION OF THIS CONTEST MAY BE A VIOLATION OF CRIMINAL AND/OR CIVIL LAWS. SHOULD ANY SUCH ATTEMPT BE MADE, INDIGO RESERVES THE RIGHT TO SEEK REMEDIES AND DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING BUT NOT LIMITED TO CRIMINAL PROSECUTION, AND TO BAN OR DISQUALIFY AN ENTRANT FROM THIS AND FUTURE CONTESTS.
  31. Release of liability / Consent to publicity

  32. By entering this Contest and accepting the prize, the winner: (i) confirms compliance with the Contest Rules; (ii) acknowledges that the prizes herein are not transferable, refundable, may not be exchanged or converted for cash (except as provided for herein and only at Indigo’s sole and absolute discretion), and cannot be replaced if lost or stolen, and must be accepted as awarded except where stated; (iii) consents to the use of his/her name, city, comments, photographs and/or other likenesses for publicity, advertising or informational purposes in any medium or format carried out by Indigo and/or advertising agencies regarding the Contest or the prize, without further notice or compensation; and (iv) releases Indigo, its respective affiliates (including, without limitation, its parent, sister and subsidiary companies), advertising and promotional agencies, public relations agencies, suppliers of materials or services related to the Contest and all of their respective shareholders, directors, officers, employees and agents, as well as Twitter (collectively the "Releasees") from and against all liability in connection with the Contest and/or the awarding and/or use of the prize, including, as set out below in the Limitation of Liability section.
  33. Limitation of Liability

  34. Releasees do not assume any responsibility and each entrant releases Releasees from any and all claims, actions, damages, demands and liabilities of whatever nature or kind arising out of, or in connection with the entrant's participation or attempted participation in the Contest and prize, including, without limitation the administration of the Contest, the selection and confirmation of winners, and the arranging, awarding and use of the prizes. Without limiting the generality of the forgoing, Releasees are not responsible for (i) the incorrect or inaccurate capture of entry information; (ii) late, lost, stolen, illegible, contain false information, damaged, misdirected, mutilated, garbled or incomplete entries or entries that are altered or otherwise irregular, have been submitted through illicit means or do not conform with or satisfy any or all of the conditions of the Contest Rules; (iii) any loss, damage, or claims caused by the awarded prizes or the Contest itself; (iv) any failure of or problem with the Contest pages, any website associated with the Contest, or any website feature howsoever caused, including, without limitation, any problems, human or technical, printing errors, lost, delayed, garbled data or transmissions, omissions, interruptions, deletions, defects or failures of any telephone or computer lines, technical malfunctions of any computer online systems, servers, access providers, computer equipment, software, failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof including, without limitation, any injury or damage to an entrant's or any other person's computer related to or resulting from participating in or downloading any material connected to the Contest, all of which may affect a person's ability to participate in the Contest; (v) any website functionality lost due to not having cookies enabled; (vi) any errors, omissions, incorrect or inaccurate information in any Contest-related materials, including, without limitation, errors in these Contest Rules, printing or advertising errors or the failure of or problems with any equipment or programming associated with or used in the Contest howsoever caused; (vii) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer "hackers" or otherwise or (viii) any claims regarding the accepting, arranging, awarding or use of the prizes. Entry material/data that has been tampered with or altered is void.
  35. General Conditions

  36. This Contest will be run in accordance with these Contest Rules, subject to amendment by Indigo. In the event of any discrepancy or inconsistency between these Contest Rules and disclosures or other statements contained in any Contest related materials, including, but not limited to, the Contest entry form, the Contest Rules shall prevail, govern and control.
  37. Decisions and rulings of Indigo are final and binding without appeal in all matters related to this Contest and the awarding of prizes.
  38. Indigo reserves the right to modify or terminate the Contest or the Contest Rules at any time, without notice, and for any reason. Without limiting the generality of the foregoing, if due to a production or printing error or other unforeseen error, more prizes are claimed than are intended to be awarded for any prize level as stated in these Rules, Indigo reserves the right to terminate the Contest in whole or in part, or amend or suspend it and award any remaining prizes for that level through a random draw of all eligible prize claims for that prize level held following the time the Contest is terminated, suspended or amended. In no event will more than the stated number of prizes be awarded.
  39. All Contest entries become the property of Indigo and will not be returned and no correspondence will be made with or entered into except, where applicable, with the confirmed prize winners.
  40. This Contest is void where prohibited by law and is subject to all applicable federal, provincial and municipal laws and regulations. To the extent permitted by law, the Contest and these Contest Rules are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.
  41. Dispute regarding Identity of Entrant

  42. If a dispute arises regarding who submitted an entry, the entry will be deemed to have been submitted by the authorized account holder of the email address provided at the time of entry provided the name of the authorized account holder corresponds with the full name on the entry form. The individual assigned to the email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address is considered the authorized account holder. A selected entrant may be required to provide proof that he/she is the authorized account holder of the email address associated with the selected entry. All entries must be submitted from a valid email account. If the name of the authorized account holder does not accord with the full name on the entry form, the entry may be disqualified at the independent contest organization and/or Indigo’s sole and absolute discretion.
  43. Privacy

  44. Indigo is collecting and using personal data about entrants for the purpose of administering this Contest. No marketing communications will be received by entrants unless entrants provide Indigo with explicit permission to do so. Please see Indigo’s Privacy Policy here.
